國際商會國際仲裁院院長Claudia Salomon女士於2026年4月9日在柏克萊以「缺席：部分當事人未參加的國際仲裁」（An Empty Seat at the Table: International Arbitration with Non-Participating Parties）為題進行演講，其表示：
「於2020至2025年間，依國國際商會國際仲裁院仲裁規則作出的仲裁判斷中，約有六分之一（即近17%）的案件為一方當事人未參加仲裁程序所作成的缺席仲裁判斷」、
「就適用快速程序的案件（主要為爭議標的金額在2021年前為低於2佰萬美元、在2021年後為低於3佰萬美元的案件）中，則有高達25%與35%的案件為一方當事人未參加仲裁程序所作成的缺席仲裁判斷」
Claudia女士探討了下列五個至為關鍵的問題：
1. Can an arbitration proceed with only one participating party?
2. Why is default judgment available against a non-participating party in litigation, but a default award is not available in arbitration?
3. What steps are required to ensure the non-participating party has been notified of the proceedings and has an opportunity to present its case?
4. What steps are required for the arbitral tribunal to assess whether the claim is grounded in fact and law?
5. Should a non-participating party be entitled to subsequently challenge the jurisdiction of the arbitral tribunal – despite its absence from the proceedings?
