ICC Commission on Arbitration and ADR Meeting on 3 October 2026
Chen & Chang’s partner Helena Chen participated in the ICC Commission on Arbitration and ADR (“the Commission”) meeting online on 3 October 2026 in her capacity as a member of the Commission and shared her observations of ongoing[C&C1.1] tasks undertaken by the Commission as below:
The Commission has established a new working group to revise the report “Controlling Time and Costs in Arbitration.” Controlling time and costs has long been a key objective in international arbitration. Following the publication of the first edition in 2007 and the second edition in 2018, the Commission has formed the working group to update the report for its third edition. This revision will reflect the implementation of the 2026 ICC Arbitration Rules, evolving circumstances (including the development of AI), and recent practical trends.
The Commission’s Task Force on “Artificial Intelligence in Dispute Resolution” presented the draft “ICC Protocol on Arbitrators’ Use of AI” for discussion. This draft is expected to be further revised based on feedback received. Although the draft has not yet been finalized, it is clear that the ICC does not adopt a blanket prohibitionist approach to arbitrators’ use of AI. Instead, it emphasizes responsible use of AI, by establishing fundamental principles for arbitrators to follow when using AI and by categorizing the work for which arbitrators may use AI assistance into different tiers based on the nature of the work, prescribing varying levels of regulatory requirements for each tier. Helena will keep a close eye on further development of the draft and provide timely updates.
