On 27 December 2024, our Managing Partner Helena Chen C.Arb FCIArb PhD (Director, Chinese Arbitration Association, Taipei (CAA)) was invited as a commentator at the 19th Cross-Straits Economic and Trade Arbitration Symposium, co-organized by the China International Economic and Trade Arbitration Commission (CIETAC) and CAA.
During the session on “Practices of Cross-Strait Recognition and Enforcement of Arbitral Awards,” Judge Xiangyang Xi from the Supreme People’s Court of the People’s Republic of China and Kevin Kuo, Esq. (Director, CAA) respectively presented on relevant laws and latest judicial practices on both sides of the Strait. Helena and Professor Lianbin Song from China University of Political Science and Law jointly served as commentators. Drawing on her long-term observation of Taiwan’s judicial practices, Helena offered her professional insights into cross-strait arbitration practices by providing an in-depth analysis of the Taiwanese courts’ jurisprudence regarding recognition of arbitral awards made in Mainland China, including reference to objective statistical analysis, summary of grounds relied upon in each case where the court refused to recognize Mainland China awards. It was an absolute privilege to speak at this well-received Symposium. We sincerely thank the co-organizers for the invitation.
The annual Cross-Straits Economic and Trade Arbitration Symposium has been held by the CAA and CIETAC on both sides of the Straits in rotation since 2001. On 27 December 2024, our Partner Helena Chen C.Arb FCIArb PhD was invited to a closed-door meeting participated by selected representatives of the China International Economic and Trade Arbitration Commission (CIETAC) and the Chinese Arbitration Association, Taipei (CAA) to discuss further collaboration between the two institutions.
