Chen & Chang Co-hosted Webinar Titled “Energy Transition and Investment Treaty Arbitration”

On 7 December 2024, Chen & Chang had the honor of co-hosting a webinar titled “Energy Transition and Investment Treaty Arbitration” in collaboration with the ADR Committee of the Taiwan Bar Association (“TWBA”), and the Taiwan Chapter of the Ciarb EAB. The webinar attracted professionals from the legal and energy sectors.

The webinar featured Mr Jonathan Lim, Partner at WilmerHale. Drawing on his extensive experience in international commercial and investment arbitration, he focused on the legal disputes arising from energy transitions and strategies for addressing them. Jonathan pointed out that governments in many jurisdictions have attracted foreign investments to support energy transition. It then follows that investor-state disputes have arisen out of the energy transition. Jonathan, by referring to practical cases, shared his observations on cases that have occurred and elaborated on the features of “new” international investment agreements (IIAs), including general environmental provisions aimed at safeguarding the State’s policy space, specific climate action provisions, which demonstrate that social responsibility and sustainable development are highly valued in the new IIAs.

Under the adept moderation of Helena, the Q&A session was a lively exchange of ideas. The attendees, demonstrating a keen interest in energy transition policies and international arbitration issues, actively participated in the discussion. The webinar not only provided a vital platform for knowledge exchange among legal and energy professionals but also highlighted the importance and practicality of arbitration in the energy and investment sectors. Chen & Chang looks forward to continuing collaborations with various collaborators to advance arbitration in diverse fields.
