Chen & Chang’s partners, Helena Chen and Alison Chang, attended the ICC-FIDIC Conference 2025 on 15 October.

Helena actively engaged with the panel of experts and shared the experience and current status of offshore wind farm projects in Taiwan.

FIDIC is developing a new form contract for offshore wind farm projects (“FIDIC OWF Contract”) to meet a growing need in the market. Sample topics in the FIDIC OWF Contract include:

- Special Insurance Requirements

- Ownership of Data and IPR

- Inspections and rejections

- Interface Management

- The Engineer’s determinations and dispute resolution

- Vessel availability, standby and fuel price adjustment

- Marine Warranty Surveyor

- Weather downtime and suspension

- Risks of subsea conditions and geotechnical/geophysics report/data, and ‘Rely Upon Information’

- “Site” definition, Employer’s and Statutory HSE requirements

- Liabilities and indemnities (e.g., knock-for-knock vs. traditional liability)

- Transfer of care and custody of free-issue Equipment/ Plant

- Design liability, fitness-for-purpose

- Delay LDs, Employer’s risks and delays

- EoT and prolongation cost, time schedule float, concurrency

- Conflicting risk profiles between the Prime Contract and Subcontracts
