Our Managing Partner, Helena Chen C. Arb., Spoke at the “Perspectives on ICC Awards Conference” Organized by the ICC International Court of Arbitration During China Arbitration Week

Our Managing Partner, Helena Chen C.Arb FCIArb PhD, was honored to deliver an English speech on “Dissenting Opinions” at the “Perspectives on ICC Awards Conference” organized by the ICC International Court of Arbitration during the China Arbitration Week, held in Beijing on 7 September 2023.

Helena began with an analysis of ICC official data, which revealed that where a majority award is rendered, in most situations, the non-signing arbitrator will issue dissenting opinions. There are different views on whether it is appropriate for an arbitrator to issue dissenting opinions: each of the positive and negative views has its supporters with sound reasoning.

Helena elaborated on “the Good, the Bad and the Ugly” dissenting opinions as classified by Prof. Redfern, a prominent scholar in international arbitration.
